Traditional Marriage

On April 2, 2015, the Freedom of Conscience Defense Fund filed an amicus curiae brief in the United States Supreme court on behalf of Catholic Answers, urging the Supreme Court to reject the argument that the Federal Constitution creates a right to same-sex “marriage.” Ultimately, the United States Supreme Court decided that the Due Process clause of the Fourteenth Amendment. In response, FCDF President Charles LiMandri made the following statement:

“Today may very well go down in history as one of the darkest days in American jurisprudence. In his decision creating a right to same-sex ‘marriage,’ Justice Kennedy dismantled the fundamental right of the people of our nation to govern themselves. The five members of the Supreme Court who are forcing this decision on our country are also disrupting the nuclear family as a basic building block of society. The exclusive marital union of husband and wife has served our nation extremely well since its founding, as indeed it has served all great societies in the history of the world.

“The consequences of this decision to the religious liberty of people of faith will be profound, as witnessed most recently in the verdict in the JONAH case less than 24 hours ago. When political correctness trumps truth, then justice in our courts cannot be achieved, and what follows is legal anarchy and tyranny. The events of the last two days must serve as the final wake-up call to all freedom loving Americans, or the future of our nation is very bleak indeed. In the meantime, people of faith, who place their hope and trust in God, take comfort in the knowledge that His truth and justice will ultimately prevail."

Previously, on January 28, 2014, the Freedom of Conscience Defense Fund filed an amicus curiae brief in the Ninth Circuit Court of Appeals, urging the Court to uphold Nevada’s constitutional ban on same-sex marriage.  

The brief was filed on behalf of three renowned scholars – Robert P. George, SherifGirgis, and Ryan T. Anderson – who have studied and published on the moral, political, and jurisprudential implications of redefining marriage to eliminate the norm of sexual complementarity.  Their article, “What Is Marriage?” appeared in the Harvard Journal of Law and Public Policy. Their book, What Is Marriage? Man and Woman: A Defense, further develops their philosophic defense of marriage as a conjugal union.
